Sintesi

International Child Abduction (ICA) occurs frequently in the EU and has a profound psychological and emotional impact on all the minors involved. This impact can be further aggravated by a slow and complicated legal process due to the lack of adequate cooperation between central authorities, legal professionals, and family mediators.

Based on this, and prioritizing the best interest of the child, iCare2 will develop and implement new tools and activities to improve the situation of children in ICA cases by strengthening judicial cooperation and incorporating International Family Mediation (IFM) as a complement to the judicial process. This will result in a child-friendly legal process, efficient in terms of cost and time for ICA cases.

The project addresses the challenges arising from the application of the new Regulation (EU) 2019/1111 of June 25, 2019, including the importance of protecting children’s rights, the central role of family mediation in cross-border disputes, and strengthening the work of Central Authorities. All of this will be carried out through a multi-level approach, in close collaboration with relevant national actors such as civil society organizations and universities in Italy, Bulgaria, France, and Poland, with the intention of expanding the project to the entire European context with the support of networks such as Missing Children Europe and International Social Service.

Objectives


The project aims to support the implementation of the new Regulation (EU) 2019/1111 of June 25, 2019, concerning jurisdiction, recognition, and enforcement of decisions in matters of marriage, parental responsibility, and international child abduction. This regulation seeks to strengthen international family mediation with a particular focus on children’s and adolescents’ rights.

The iCare2 initiative aims to create solid reference points for pre-mediation in partner countries, based on best practices already in place in EU Member States.

Main project activities:
  • Research activities will be carried out in Italy, Bulgaria, France, and Poland to assess how the “Brussels II-ter” Regulation is being implemented, with the goal of developing recommendations to improve its application. The main outputs will include national reports (one for each participating country) and a transnational document containing European-level Guidelines.
  • Training pathway with activities aimed at sector professionals; a “Train the Trainer” event and national MeetUps to share knowledge and best practices.
  • Study visit in France and the creation of pre-mediation offices in the partner countries (Italy, France, Bulgaria, and Poland), to facilitate access to mediation in cross-border family disputes.
  • Communication and networking activities, to disseminate project results and raise awareness of the experiences and materials produced, culminating in a final seminar at the European level.
